Workmen's Compensation (Amendment) Act, 1994.

AN ACT to amend the Workmen's Compensation Act (Cap. 377).

[10th February, 1994]

ENACTED by Parliament of Antigua and Barbuda as follows-


Short title.
1.         This Act may be cited as the Workmen's Compensation (Amendment) Act, 1994.

Amendment of section 8 of Cap. 377.
2.         Section 8 of the Workmen's Compensation Act, in this Act referred to as the principal Act, is amended in subsection (1) as follows –

(a) in paragraph (a) (i), by deleting the words "fifty thousand dollars" and substituting the words "one hundred and fifty thousand dollars";

(b) in subparagraph (b) (i) by deleting the words "sixty thousand dollars" and substituting the words "two hundred and fifty thousand dollars";

(c) in paragraph (b) (ii) by deleting the words "sixty thousand dollars" and substituting the words "two hundred and fifty thousand dollars".

Amendment of section 2 of the principle Act.
3.         Section 2 of the principal Act is amended in subsection (1) by repealing the definition of

 "ship", "vessel", "seaman" and "port" and substituting the following definitions -

"port" includes place;

"seaman", "ship", and "vessel" have the same meaning as in the Antigua and Barbuda Merchant Shipping Act, 1985;" [1/1985]

Amendment of section 33 of the principal Act.
4.         Section 33 of the principal Act is amended in subsection (1) -

(a) by repealing the words "any other British Ship" and substituting the words "any other Commonwealth Ship";

(b) in paragraph (c)

(i) by repealing the words "British Possession" on both occasions upon which they occur and substituting the words "commonwealth country";

(ii) by inserting before the words "any British Consular Officer" the words "the principal representative of Antigua and Barbuda or";

(iii) by repealing the following: "sections 694 and 695 of the Merchant Shipping Act, 1894," and substituting therefor: "sections 278 and 279 of the Antigua and Barbuda Merchant Shipping Act, 1985,";

(c) in paragraph (4) by repealing the following "the Merchant Shipping Act, 1894," and substituting the words "any law";

(d) in paragraph (f) by repealing the following: "section 503 of the Merchant Shipping Act, 1894," and substituting therefor: "sections 301 and 302 of the Antigua and Barbuda Merchant Shipping Act, 1985,";

(e)  in paragraph (g) by repealing the following: "subsections (2) and (3) of section 174 of the Merchant and Shipping Act, 1894 (which relates to the recovery of wages of seamen lost with their ship)," and substituting the words "any law that relates to the recovery of wages of seamen lost with their ship".

Amendment of section 34 of the principal Act.
5.         Section 34 of the principal Act is amended in subsections (1) and (4) as follows -

(i) in subsections (1) by repealing the words "three miles of the coast thereof' and substituting the words "the territorial sea";

(ii) in subsection (4) by repealing the following "Section 692 of the Merchant Shipping Act, 1894," and substituting therefor "Section 271 of the Antigua and Barbuda Merchant Shipping Act, 1985,". [1/1985]
